Tobacco manufacturers and retailers fined over UK price fixing

Several tobacco manufacturers and retailers in the United Kingdom have been fined a total of £225 million for price fixing. The fines were imposed by the Office of Fair Trading (OFT) following an investigation lasting seven years. It is the largest penalty ever issued by the OFT for breaches of the 1998 Competition Act, with the case involving two major tobacco makers and numerous British supermarkets.

Together the manufacturers involved, Imperial Tobacco (whose brands include Golden Virginia and Lambert & Butler) and Gallaher Group (who own Silk Cut and Benson & Hedges among others) make almost 90% of all cigarettes and roll-ups sold in the UK. They were fined £112 million and £50 million respectively.

The supermarkets facing the largest penalties were Asda and The Co-operative Group, at £14 million each. Other stores fined were First Quench, Morrisons, Safeway, Shell garages, Somerfield, T&S Stores (now One Stop) and TM Retail. Also taking part in the price fixing were Sainsbury’s, though they received immunity from being fined after alerting the OFT and co-operating with the investigation. Some of the other companies also earned reductions in their fines through co-operation with the OFT.

Similar allegations against Tesco were not pursued due to a lack of evidence.

Imperial Tobacco denied the charges, claiming in a statement that its dealings with the retailers were simply legitimate “promotional arrangements”. They have said they are considering an appeal against the decision.

In a press release the OFT said that the fines would send out a strong message. “Practices such as these, which restrict the ability of retailers to set their resale prices for competing brands independently, are unlawful.” said Simon Williams, OFT Senior Director of Goods. “They can lead to reduced competition and ultimately disadvantage consumers.”

“This enforcement action will send out a strong message that such practices, which could in principle be applied to the sale of many different products, can result in substantial penalties for those who engage in them.”

1000 homes evacuated in Plymouth, England, after bomb find

The discovery of an old World War II bomb in a construction site has caused at least 1000 residents in Plymouth located in South-West England, to be evacuated.

“Evacuations are being carried out of properties within 100m [328ft] of the scene. Properties within the 100m-300m [328-984ft] zone are being advised to open windows and draw curtains,” said a spokesman for the police department in Plymouth.

Workers on the site discovered the bomb at about 10:30 a.m. local time in Plymouth, England on Brentor Road.

Reports say that the bomb is sticking out of the ground by about 6 inches, and weighed an estimated 113 kilograms, or 250 pounds, but could have weighed as much as 500 pounds.

“The item was protruding about six inches from the ground and was described as being up to 10-inches in diameter,” said a spokesman for the Devon and Cornwall Police.

The Army bomb disposal team from Wales is currently trying to figure out what to do with the bomb and it could take several hours before authorities can dispose of it. Reports say that the bomb will be taken to the ocean to be detonated.

“The precise nature of this operation and any potential route are yet to be confirmed,” added the spokesman.

Blow out sales prices likely on mattresses as new U.S. fire-resistant standards take effect

If you are in the market for new bedding, and not too concerned with the new United States guidelines for mattress fire resistance, now might be a good time to buy. Mattresses sold in the U.S. must meet new federal guidelines for flammability starting on July 1.

The peak heat release rate is limited to 200 kW during a 30 minute test. The total heat release is limited to 15 MJ within the first 10 minutes.”

The flammability of mattress sets sold in the U.S. is subject to a new mandatory federal regulation requirement passed by the Consumer Product Safety Commission (CPSC) on February 16 last year. The requirement, costing mattress manufacturers an estimated $100 million to meet, is scheduled to take effect on July 1. The commission anticipates that the new standards will save 270 lives and 1,330 injuries per year from mattress fires.

“We’ve passed a new open flame regulation and the whole idea behind the regulation is to make sure that if a mattress catches on fire that the fire burns slowly enough that people have enough time to get out of the house and get away,” said Hal Stratton, chairman of the CPSC

Radio and TV advertising spots are reacting to the new regulation by discounting prices on mattresses that fail to meet the new guidelines. Sales made in the mattress industry, like the automobile industry, are highly negotiable on price. The new regulation does not appear to have much “teeth” for mattresses already in the distribution pipeline, but it is a new law that is a bargaining position for potential buyers.

Four dead, at least 15 injured after gunman opens fire at fitness center in Bridgeville, Pennsylvania

Four people have been shot and killed and at least 15 wounded when a gunman opened fire inside a LA Fitness center in Bridgeville, Pennsylvania. The gunman was among the dead.

Reports say the man walked into a dance room where an all-female Latin dance class was in session, turned off the lights and began to shoot people. CNN reports that the gunman was a “middle-aged white male.” One witness said he was carrying a duffel bag, which he put down before shooting into the crowd. After opening fire, he turned the gun on himself. At least 30 people are reported to have been in the room at the time of the shooting.

Allegheny County police Superintendent Charles Moffatt said, “I’ve never seen nothing quite like this. It was very chaotic. […] There’s a good belief that the shooter is deceased.”

Collier Township Police Chief Tom Devin stated that the police, “believe the shooter committed suicide at the scene but we’re not positive.” Police report that the shooter’s motive may have been a domestic dispute with one of the exercisers.

Mike Hentosz, a witness who was inside the gym, said, “I feel like it’s a dream. I don’t know what to think of it.” A woman participating in the class, Nicole, said that 10 minutes into the class, “a middle-aged white male walked into the class. He had a big gym bag. […] He looked out of place in a class full of women.” When he began firing, she reported, she ran out of the gym and escaped in passerby’s car.

Bystanders jeered at whether any victims could fit aboard the crowded craft. No report on rescue stunts. Local authorities had previously been criticized for not allowing volunteer boaters in to help.

Morgan Freeman, whose home fared well, is organizing an online auction of celebrity items at charityfolks.com, to benefit the American Red Cross Disaster Relief Fund.

Curt Schilling opened his home to a family of nine driven out of their New Orleans home. The Schilling family will provide housing for the Fields for a year while their home in New Orleans is rebuilt and repaired.

Canada women’s national wheelchair basketball team gets its first win of London Paralympics

London, England — Yesterday at London’s Basketball Arena, the Canada women’s national wheelchair basketball team earned their first victory of the London Paralympics when they defeated the Australia women’s national wheelchair basketball team 57–50.

Canada took a one point lead into the second half, when the scores were 33–32 because of a last minute foul that sent Canada to the free throw line where they capitalized by making one of their shots. 4.5 point player Janet McLachlan and 2 point player Katie Harnock dominated in minutes played for Canada during the first half, playing all 20 minutes and leading their team in scoring with 11 first half points for McLachlan and 12 for Harnock. The Canadian team was loudly supported by spectators, earning more cheering from the largely Great Britain supporting fans than the Australians.

The second half saw Canada slowly increase their lead, keeping tied with Australia 4–4 in the first half of third, 6–4 in the last half of the third, 6–4 in the first half of the fourth, and 8–6 in the last half of the fourth. McLachlan finished the game as Canada’s leading scorer with 28 total, 17 in the second half. Harnock had a quieter second half only scoring 2 points to finish with 14. Cindy Ouellett was the team’s third leading scorer, finishing the game with ten.

The Canadian team supported their team from the bench, chanting “Get it out! Get it out!” when on defense and “Let’s go Canada” when on the offense. Other times, one player led the team in chanting support for their players on the court. The team was consistently louder than the Australian bench.

Throughout the game, the Canadians tipped themselves over more in their chairs than the Australians. Ouellett tipped once, and bounced in her chair, with a wheel leaving the ground as she attempted to block shots and steal the ball. Ouellett and Australian Cobi Crispin locked wheels, and required a break in the game where Australia’s coach came on to the court and removed Ouellett’s wheel to detach the pair before putting it back on again.

Following the game, Australia’s Amber Merritt said of playing Canada, “I have the utmost respect for Canada. They’re a great team, but we’ll refocus on the game tomorrow [against the Netherlands] and go out and play like we know we can, the Australian way.”

Prior to the start of the game, McLachlan was the team’s dominating player in the competition. She was ranked eighth in the competition in field goal percentage, and was Canada’a highest ranked player in this category. She ranked second in the tournament in total field goals made per game, with 12. Teammate Katie Harnock ranked eighth. Tara Feser ranked fourth in the tournament for 2 point field goal percentage at 57.1%, while McLachlan ranked ninth with 50.0%. McLachlan was second in 2 point field goals made per game, at 12. Harnock was tied for first with Mexico’s Floralia Estrada Bernal in the competition for 3 point field goal percentage at 20%, and was ranked second in the tournament for most 3 point field goals made with one.

As a team coming into the game, Canada was ranked sixth in total field goal percentage, eighth in free throw percentage, sixth in average rebounds per game, second in fouls, and last in turnovers.

Coming into this game, Canada had lost their first game 70–59 to the Netherlands. They are scheduled to play Brazil today.
