Buffalo, New York —A proposed hotel that was supposed to be built at the corner of Elmwood and Forest Avenues in Buffalo, New York is apparently off the table. The former proposal was going to be called The Elmwood Village Hotel and would have consisted of 72 rooms and cost between $7 to $10 million American dollars to build.

Today several unknown individuals were seen removing a sign that was dedicated to the “Elmwood Village Gateway,” which signifies the beginning of the Elmwood Village at the formerly proposed project’s location.

Nearly an hour later the men replaced the sign with a different and unexpected sign: “For Sale: 5 commercial parcels and 1 carriage house, By: Owner.” Those 5 “parcels” are 1109-1121 Elmwood and 999 Forest Avenue, which is located in an illegal alley, according to the City of Buffalo, behind the 5 other properties on Elmwood. Hans Mobius owns all properties named in the sale.

Sam Savarino, CEO of Savarino Companies never owned the properties and has repeatadly told Wikinews in exclusive interviews that he still had a “contract to buy the properties” and on October 2, 2006 told Wikinews in an exclusive interview that he “extended” the “agreement to purchase the property[s] and will have it under contract for what we hope is a sufficient period of time.”

“He [Mobius] is undoubtedly concerned because he has lost some tenants and is a bit impatient. I think he has properly portrayed the situation,” said Savarino in an exclusive interview with Wikinews.

Savarino also says that there may be “legal issues” to work out now, before anything else can move forward, regarding the proposal.

“There are some legal complexities that must be sorted out before anything can happen there,” added Savarino.

The welcome sign was; however, not removed entirely. The sign was placed, facing the same direction of north, on the side of the Forest Plaza Art Gallery, a new art gallery located on the corner of Forest and Elmwood.

Nancy Pollina, owner of Don Apparel which was located at 1109 Elmwood, but closed on October 14, 2006 considers this a possible “victory” in regards to the lawsuit filed against the hotel to stop it from being built, alleging that several laws were broken, including not performing an Environmental Impact Study before the proposal was approved by the city, during its approval and the proposal was “rushed.” Patricia Morris, who operates Don Apparel with Pollina, Angeline Genovese and Evelyn Bencinich, owners of residences on Granger Place which abut the rear of the proposed site, Nina Freudenheim, a resident of nearby Penhurst Park, and Sandra Girage, the owner of a two-family residence on Forest Avenue less than a hundred feet from the proposed hotel’s sole entrance and exit driveway, were also plaintiffs in the lawsuit. They filed the suit with a lawyer representing them, Arthur J. Giacalone, on April 25, 2006 in New York State Supreme Court, but the case has never gone to a courtroom.

Giacalone believes that a press release issued in July regarding the project was nothing but a statement to “save face,” but that the placement of the for sale sign might be a way of convincing Savarino to speed up the sale of the properties.

“I thought all along that Savarino’s July press release might be no more than an effort to save face. But we have no way of knowing. Similarly, Mobius might have put the for-sale sign up in an attempt to pressure Savarino into closing the deal. There’s no way to tell,” said Giacalone in an exclusive interview with Wikinews.

In regards to the lawsuit, Giacalone thinks it may now be in “limbo.”

“The lawsuit still sits in limbo,” added Giacalone.

Gastric bypass surgery performed by remote control

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.

Buffalo, New York —Attorney Arthur J. Giacalone has filed a lawsuit in New York Supreme Court against the city of Buffalo‘s Common Council and Planning board, alleging that the proposed Elmwood Village Hotel was approved “without giving meaningful consideration to either the impact on the adjoining residential neighborhood, or the unique character of this section of Elmwood Avenue.” Giacalone is representing Nancy Pollina and Patricia Morris, who operate the Don Apparel (a vintage clothing and collectibles shop at 1119 Elmwood Avenue), Angeline Genovese and Evelyn Bencinich, owners of residences on Granger Place which abut the rear of the proposed site, Nina Freudenheim, a resident of nearby Penhurst Park, and Sandra Girage, the owner of a two-family residence on Forest Avenue less than a hundred feet from the proposed hotel’s sole entrance and exit driveway.

The Elmwood Village Hotel is a 72-room, seven-million-dollar hotel proposed by Savarino Construction Services Corporation and designed by architect Karl Frizlen of the Frizlen Group. Its construction would require the demolition of at least five buildings, currently at 1109-1121 Elmwood, which house several shops and residents. Although the properties are “under contract,” it is still not known whether Savarino Construction actually owns the buildings. It is believed that Hans Mobius, a resident of Clarence, New York and former Buffalo mayoral candidate, is still the owner. The hotel is expected to be a franchise of the Wyndham Hotels group.

The lawsuit, filed in State Supreme Court, is seeking annulment of the City of Buffalo’s rezoning and site plan approvals for the hotel.

“Had the Common Council members complied with State law and waited to receive comments from the County’s planning agency, they would have been obliged to address the County’s concerns regarding the replacement of former residential buildings with ‘a much larger commercial structure’, the health effects of placing a 55-vehicle parking area next to existing homes, and the absence of a traffic study to assess the likelihood that the project would add ‘considerable congestion’ to the Elmwood/Forest intersection,” said Giacalone.

“The four-story hotel will overshadow the neighboring homes and backyards, impacting quality of life and property values. Equally as important, the project will displace a unique and diverse group of businesses that have served nearby college students and Buffalo’s arts and theater community for many years, and replace them with upscale retail establishments that will cater, not to local residents, but to affluent tourists and business travelers,” added Giacalone.

On March 22, 2006 the city’s Common Council approved the rezoning for the proposed hotel and on March 28, the Planning board approved the design and site plan of the hotel.

The lawsuit, entitled Pollina et al. v. Common Council of the City of Buffalo et al., [Index No. I-2006-3885], has been assigned to the Honorable Rose H. Sconiers, and is scheduled for oral argument at 9:30 A.M. on Thursday June 8, 2006.

* Psychological treatments are designed to reduce stress and muscle relaxation.

* Pharmacological and physiotherapy treatments are also used to reduce contractures and associated pain.

Federal judge rejects hate crime plea in Arbery killing

On Monday, Judge Lisa Godbey Wood of the U.S. District Court in Brunswick, Georgia rejected a guilty plea from Travis McMichael after McMichael offered in court to plead guilty to federal hate crimes in the death of Ahmaud Arbery.

It is highly unusual for a U.S. judge to reject a plea agreement, which would waive McMichael’s right to appeal.

McMichael said he was willing to plead guilty to attacking Arbery out of racial animosity, which would make Arbery’s murder a hate crime. In the proposed plea deal, he would have spent the first 30 years of his sentence in a federal prison. After that, he would move to a Georgia state prison for the rest of his life. Per this deal, even if his state charges were overturned, McMichael would still spend many years in prison.

In court, federal prosecutors urged Judge Wood to accept the plea deal, but Arbery’s family asked her not to. The dead man’s mother, Wanda Cooper-Jones, said that the men who killed her son did not deserve to choose their living conditions: “Granting these men their preferred choice of confinement would defeat me. It gives them one last chance to spit in my face.”

Prosecutors claimed they had talked with the victim’s family about the plea deal in advance, but lawyers for Cooper-Jones disagreed.

Judge Wood explained that Cooper-Jones’ statement was part of her decision, but her main reason was that she did not want to be held to the strict 30-year sentence agreed upon by prosecutors and McMichael’s lawyers.

Wood’s decision casts doubt on whether McMichael’s father, Gregory McMichael will also plead guilty as planned. Gregory McMichael also helped kill Arbery.

In February 2020, the McMichaels and a third man, William Bryan, chased Arbery, 25, in trucks as he jogged through their suburban Georgia neighborhood. Travis McMichael then fought with Arbery on foot and shot him to death. Bryan took cell phone video of the event, which later appeared on the Internet.

In November 2021, all three men were convicted of murder in Georgia’s Glynn County Superior Court. They were sentenced to life in prison, though only Bryan was granted the possibility of parole. The state of Georgia did not at that time have its own hate crime law, and prosecutors decided to charge the men on the federal level.

Jury selection for Travis McMichael’s federal hate crimes trial is scheduled to begin on Monday, February 7.

Romanian VAT to remain at 19 percent

Popescu has responded to public fears of a rise in value added tax (VAT) by saying that Romania’s VAT will remain at 19% and will not increase. He rejected rumours that the value added tax, which is applied to most goods and services, will increase due to negotiations with the International Monetary Fund and a need to boost government revenue.

After introducing a low flat tax rate of 16% on January 1, 2005, which applies to both personal income and corporate profits, the government has had to fund the tax cuts through alternative means, including increases in other types of taxation, to avoid running a high budget deficit. For example, from April 1, the government will increase excises as well as a range of other taxes. Despite the increase, Romania continues to have one of the lowest fiscal burdens in Europe due to the new 16% flat tax rate.

Wikinews attends Maker Faire in Tyler, Texas

Wikinews attended the sixth annual Mini Maker Faire in Tyler, Texas, United States on Saturday. Similar to a giant science fair, the event featured a variety of science, engineering and technology projects and items.

An array of technologies were on hand including 3D printers, drones, and various other physics devices. The owner of the Make Crate subscription service stated her company’s products place a strong emphasis on teaching young people about technology and coding. A traditional blacksmith was also on hand displaying metal working techniques.

Numerous Maker Clubs from an array of local schools were on hand, displaying a broad swathe of tech projects. A group of amateur hobbyists diplayed a model of the deck of the aircraft carrier, the USS Ronald Reagan with a solenoid device hooked up to launch paper airplanes.
